| Abstract: | هدفت هذه الدراسة إلى إلقاء الضوء على كل من الشروط التجارية وكذا التأمين الدولي، و التي تعتبر من أهم الأدوات التي من شأنها العمل على تقليص الأخطار المصاحبة لغالبية المعاملات التجارية خاصة تلك التي تتم عن طريق النقل البحري. وعلى الرغم من أن الشروط التجارية حددت تقاسم المسؤوليات ، الأخطار و التكاليف بين أطراف عمليات البيع والشراء من مصدر و مستورد ،و على اعتبار أن النقل الدولي للبضائع عبر المسافات الكبيرة يعرض البضاعة للخطر، كان لزاما على تلك الأطراف البحث عن ضمانات أخرى تمثلت في القيام بعملية التأمين، و على هذا الأساس هدفت هاته الدراسة إلى تحليل التأثير المتبادل لكل من التأمين و شروط التجارة الدولية على بعضهما في الجزائر. توصلت الدراسة إلى أن التشريعات المتعلقة بالتأمين و النقل و الدفع حدت من استخدام الشروط في الجزائر، و أن الاستخدام يقتصر على ثلاث شروط من أصل 11 شرطا ، في المقابل، هناك تأثير للشروط على التأمين و نوع التأمين المختار. |
| Description: | This study aims to shed light on both Incoterms and international insurance, which are one of the most important tools that reduce the risks associated withthe international transport of goods, especially sea transportation. Although the incoterms specified the sharing of responsibilities, risks and costs between exporters and importers, and given that transporting goods over long distances exposes them to risk, it was necessary for those parties to search for other guarantees represented in carrying out the insurance process, and on this basis this study aimed to analyze the mutual impact of both international insurance and incoterms on each other in Algeria. The study concluded that the legislation related to insurance, transportation and payment limited the use of incoterms in Algeria, and that the use is limited to three incoterms out of 11; On the other hand, there is an effect of the incoterms on the insurance and the type of insurance chosen. |
