| Abstract: | النزاعات العمل الجماعي أصبحت تستوجب الطرق الحديثة في حلها والتخلي عن تلك الطرق الكلاسيكية، وما نقصد به بالطرق الحديثة هي التفاوض الجماعي وهو ما سع إليه المشرع من حيث التعديل الأخير في الوقاية من النزاعات العمل، والإضراب هو ما قصدناه بالطرق الكلاسيكية أي اعتماد على التوقف الجماعي عن العمل وهذه خطوة بحد ذاتها خسارة لكلا طرفين لذلك تبقى مجرد آداه للضغط وفقط، لكن حل نزاع والتوصل إلى نتائج مرضية وتخدم الطرفين يكون باعتماد على إجراءات الودية وهي كل من المصالحة والوساطة والتحكيم، وتبقى هذه الإجراءات في الإطار الإداري وبمميزات السرعة في اتخاذ الإجراءات والتنفيذ، كما تسبقها الإجراءات الوقائية وهي الوسيلة الأحسن لتفادي كل هذه النزاعات أي باتخاذها إجراءات في التنظيمات علاقات العمل قبل حدوث النزاع وهذا باعتبارها إجراءات استباقية |
| Description: | Teamwork conflicts now require modern approaches for resolution, abandoning traditional method, What is meant by modern approaches is collective bargaining, which the legislature has leaned towards in the recent amendment aimed at preventing workplace conflicts, The strike is what we referred to as traditional approaches, relying on collective cessation of work, which inherently entails losses for both parties. Thus, it remains merely a tool for pressure. However, resolving conflicts and reaching satisfactory outcomes that serve both parties is achieved through adopting amicable procedures, namely reconciliation, mediation, and arbitration ,And these measures remain within the administrative framework and are characterized by the speed in decision-making and implementation. They are preceded by preventive measures, which are the best means to avoid all these disputes, i.e., by taking measures in organizing labor relations before the dispute occurs, considering them as proactive measures |
