| Résumé: | يدعوا هذا البحث إلى الدور الذي يلعبه القاضي الإداري في تجسيد القواعد ، باعتباره ذلك الحامي لها من تعسف الإدارة التي قد تتجاوزها بحجة السعي لتحقيق المصلحة العامة ، وبالنظر للامتيازات التي منحها لها القانون والمتمثلة في اصدارها لقرارات ادارية انفرادية ملزمة للأفراد دون الحاجة لموافقتهم عليها ، ودون الحاجة ايضا للجوء الى القضاء للاعتراف لها بذلك ، الأمر الذي جعلها الطرف الأقوى في علاقتها ومعاملاتها معهم. |
