Abstract: يدعوا هذا البحث إلى الدور الذي يلعبه القاضي الإداري في تجسيد القواعد ، باعتباره ذلك الحامي لها من تعسف الإدارة التي قد تتجاوزها بحجة السعي لتحقيق المصلحة العامة ، وبالنظر للامتيازات التي منحها لها القانون والمتمثلة في اصدارها لقرارات ادارية انفرادية ملزمة للأفراد دون الحاجة لموافقتهم عليها ، ودون الحاجة ايضا للجوء الى القضاء للاعتراف لها بذلك ، الأمر الذي جعلها الطرف الأقوى في علاقتها ومعاملاتها معهم.
Description: This research calls for the role that the administrative judge plays in embodying the rules, as he is the one who protects them from the arbitrariness of the administration that may violate them under the pretext of seeking to achieve the public interest, and in view of the privileges granted to them by the law, represented by their issuance of unilateral administrative decisions binding on individuals without the need for their approval, and without the need to Also, to resort to the judiciary to recognize this for her, which made her the stronger party in her relationship and dealings with them, and her enjoyment of independence from the administrative judiciary, ensuring that it does not interfere in her affairs, or force her to do what she does not want, so the prevailing principle became the inadmissibility of issuing orders from the administrative judge. The administration or its replacement, even within the scope of its restricted authority, because its mission is the judiciary and not the administration, which made it stop at stating the rule of law in what is disputed only, without going beyond it to the issue of its implementation
