| Abstract: | يعتبر الحق في الرجوع عن التعاقد الالكتروني احدى الاليات القانونية التي تهدف الى بسط حماية فعالة لرضا المستهلك الالكتروني المتعاقد عبر وسائل الاتصال الحديثة، و هو من بين الاليات التي اقرتها التشريعات الخاصة كاستثناء عن قواعد النظرية العامة للعقد، و يعد وسيلة حمائية للطرف الضعيف نتيجة لحالات الضعف المتأتية سواء من اعتبارات أخلاقية او من الحاجة او من وضعية الاحتكار او من الإذعان او من عدم التحكم في التقنيات الحديثة وغيرها ، فالمستهلك لا تتوافر لديه الإمكانيات الفعلية لمعاينة السلعة و التحقق من جودتها لذلك منحت التشريعات المنظمة للمعاملات الالكترونية هذا الحق للمستهلك . وعليه حاولنا من خلال هذه الدراسة معالجة هذا الموضوع مع تبيان موقف التشريعات بما في ذلك المشرع الجزائري من الحماية الإضافية الممنوحة للمستهلك بصفته طرفا ضعيفا بغية إعادة التوازن العقدي وإضفاء نوع من العدالة العقدية في العقود المبرمة عن بعد. |
| Description: | The right of retraction to electronic contracting is a modern legal mechanism to providing effective protection for the consent of remotely contracted consumer through modern means of communication, He is also one of the procedures sanctioned by special legislation as an exception to the general theoretical rules of the contract. It is also a protective principal for the weak party due to cases of weakness resulting from either ethical issues; need, monopoly, or inexperienced use of modern techniques, etc The consumer does not have the real possibility to inspect the good and verify its quality, so the legislation governing electronic transactions gives the consumer this right. Therefore, we tried through this study to address the essue while clarifying the position of some legislations, Including the Algerian legislator, wish aims to stand by the consumer as a week party in order to restore the contractual balance to impart a kind of contractual justice to the electronic contract |
