| Abstract: | السلطة التقديرية للقاضي في تعديل العقد ، حيث تسلط الضوء على دور القاضي في التدخل لتعديل العقود في بعض الحالات المحددة ، يتم استعراض القاعدة العامة للعقد ومبدأ احترام ارادة الأطراف ومع ذلك يتم تحديد الحالات التي يسمح فيها القاضي بالتدخل بموجب نصوص صريحة لاعادة التوازن الى العقد وحماية الأطراف. |
| Description: | This paper sheds light on the role of the judge in intervening to modify contracts in certain specified cases. It reviews the general principle of contracts and the principle of respecting the parties' will. However, it identifies the cases in which the judge is allowed to intervene by virtue of explicit provisions to restore balance to the contract and protect the parties. These cases include exploitation-induced injustice, arbitrary conditions in contracts, emergency circumstances, and the inclusion of excessively punitive clauses in contracts. The paper also highlights the judge's role in maintaining the continuity of contractual relationships by granting judicial deadlines as a means of contract rectification |
