| Abstract: | يتمحور موضوع دراستنا حول الأهمية التي يوليها المشرع للصفقات العمومية وذلك نظرا للدور الحيوي الذي تلعبه في اقتصاد اي دولة ، فالصفقات العمومية تعد من المجالات الاستراتيجية التي تستهلك موارد المال العام في الجزائر ، وتساهم في تنفيذ المشاريع التنموية ، ولهذا السبب شهد نظام الصفقات العديد من التعديلات والنصوص القانونية على مدى السنوات بدءا من القانون الأول الذي صدر عام 1967 وصولا الى اخر تنظيم عام 2015 بموجب المرسوم الرئاسي 15-247، وبالنظر الى اهمية الصفقات العمومية في الواقع الاقتصادي والسياسي فانه يتعين تحديد مفهومها بدقة من خلال استعراض المراجع القانونية المختلفة التي صدرت بشأنها. |
| Description: | Our study revolves around the importance given by legislators to public procurement, given its vital role in the economy of any country. Public procurement is considered one of the strategic areas that consumes public funds in Algeria and contributes to the implementation of development projects. For this reason, the procurement system has witnessed many amendments and legal texts over the years, starting from the first law issued in 1967, to the latest regulation in 2015 under Presidential Decree 247/15. Considering the importance of public procurement in the economic and political reality, it is necessary to accurately define its concept by reviewing the different legal references issued on the subject |
