| Résumé: | تعد عقود التعمير كوسيلة اساسية تسمح بمراقبة اشغال البناء وتحقق من مدى تناسق المشروع المراد انجازه مع احكام قانون التهيئة والتعمير ، بحيث نظم المشرع عمليات التعمير من خلال فرض دراسات قبلية وبعدية لإستكمال عملية البناء، تتولاها جهات مختصة بدراستها ، وفق إجراءات قانونية منصوص عليها في المرسوم التنفيذي رقم 15-19 اﻟذي يحدد كيفيات تحضير وتسليم عقود التعمير، ﺗﻬدف إلى الحفاظ على النظام العام والأمن العام في اﻟﻤﺠتمع. إلا أن الظاهر يوحي بالخطر خاصة في الآونة الأخيرة، حيث أصبحت معظم المدن الجزائرية عبارة عن بنايات غير مكتملة الإنجاز، مما أثر سلباً على المظهر الجمالي ﻠﻟمدينة، فكان القانون رقم 08-15بمثابة حل للحد من هذه الظاهرة، خاصة فيما يتعلق إلا أن الظاهر يوحي بالخطر بتسوية البنايات، ليليه بعدها المرسوم التنفيذي رقم 22-55 ليحدد شروط تسوية البنايات ﻏير المطابقة لرخصة البناء المسلمة. |
| Description: | Construction contracts are consided as a basic method that allows for monitoring construction works and verifying the consistenecy of the project to be completed from the provisions of the planning and construction law. So that the Algerian project organized the reconstruction operations by imposing pre-and post-studies to complete the construction process, which are undertaken by competent authorities to study them, according to legal procedures stipulated in Executive Decree No.15-19, which determines the modalities for preparing and delivering construction contracts, aiming to maintain public order and security in the country .the society. However, the appearance suggests danger, especially in recent times, as most Algerian cities have become incomplete building, which negatively affected the aesthetic appearance of the city. Law No 08-15 was a solution to reduce this phenomenon, especailly with regard to Executive No 22-55 to determine the conditions for the settlement of building that do not conform to the valid building permit, to the level of building, followed by the decree |
