| Abstract: | الشفافیة مبدأ من أهم المبادئ التي ترتكز علیها الصفقات العمومیة، حیث یعتبر محور اهتمام كل من الفقه والقضاء لعملیة إبرام الصفقات العمومیة وسیرها، كما یعد هذا المبدأ آلیة من آلیات الحكم الراشد، العمل بالشفافیة هو في حد ذاته حمایة وضمان من قبل الإدارة الراشدة. ونظرا للأهمیة التي اكتسبتها الصفقات العمومیة ومن أجل الحفاظ على المال العام، وإرساء الشفافیة على الصفقة المبرمة بین المصلحة المتعاقدة والمتعامل المتعاقد، قام المشرع الجزائري بتخصیص باب كامل للرقابة في تجسید مبدأ الشفافیة |
