| Abstract: | هدفت الدراسة إلى تسليط الضوء على انعكاس الغاء القاعدة 51/49 على الاستثمار الأجنبي المباشر في الجزائر، حيث تناولت واقع الاستثمار الأجنبي المباشر الوارد إلى الجزائر من 2003 إلى 2023، في كل من فترة تطبيق القاعدة 51/49، وفي فترة إلغائها، و تطرقت لمدى جاذبية المناخ الاستثماري في الجزائر من خلال الاطلاع على القوانين والتشريعات المتعاقبة التي اتخذتها الجزائر، توصلت الدراسة إلى أن فرض القاعدة كان من أهم العوائق التي أدت إلى تعطيل الاستثمارات الأجنبية المباشرة، ما ترتب عنه ضعف حجمها وارتفاع نفقات الدولة، لذا عملت الجزائر على توفير ميكانيزمات جديدة تناسب المستثمر الأجنبي تجسدت في قانون الاستثمار الجديد الذي يهدف إلى ترقية وتطوير الاستثمار من خلال إلغاء القاعدة 51/49 في أغلب القطاعات، مع الحفاظ عليها في ستة قطاعات سميت بالاستراتيجية، ويؤكد إلغاؤها الرؤية الجديدة والمنفتحة على المبادرات القادرة على خلق القيمة المضافة والرفع من نسب التشغيل، وتنويع الاقتصاد خارج المحروقات، خاصة وأن الدولة تقدم تحفيزات كبيرة ومهمة للمستثمرين الأجانب، من جهة أخرى، اعتبر المشرع الجزائري إبقاء القاعدة في القطاعات الاستراتيجية جزءا من الحل للمحافظة على السيادة الوطنية في هذه القطاعات |
| Description: | This study aimed to shed light on the impact of the repeal of the 51/49 partnership rule on foreign direct investment in Algeria. It dealt with the reality of foreign direct investment inflows to Algeria from 2003 to 2023, during the period of the application of the 51/49 rule and after its repeal. The study also attempted to analyze the attractiveness of the investment climate in Algeria by examining the successive laws and regulations adopted by Algeria. The study concluded that the imposition of the 51/49 rule was one of the main obstacles that hindered foreign direct investments. Therefore, Algeria has worked on providing new mechanisms that are suitable for foreign investors, as reflected in the new investment law, which aims to promote and develop investment by canceling the 51/49 partnership rule in most sectors while maintaining it in six strategic sectors. The cancellation of this rule confirms the new and open vision of initiatives capable of creating added value, increasing employment rates, and diversifying the economy outside of hydrocarbons. On the other hand, the Algerian legislature considers the retention of the rule in strategic sectors as part of the solution to preserve national sovereignty in these sectors |
