| Abstract: | لقد انتقل الوقف في عصرنا الحالي من موقع الشعيرة التي يتقرب فيها إلى تعالى ابتغاء مرضاته، إلى مستوى المؤسسة الاجتماعية ذات الأثر الكبير في التنمية بكل مجالاتها ومتطلباتها، فلم يعد يخف الدور الذي يقوم به الوقف في تفعيل التنمية الاجتماعية والاقتصادية، إذ صار رافدا مهمّا من روافد التطور في البلدان النامية. إنّ الوضعية التي يمتاز بها الوقف اليوم هي بالأصل راجعة إلى الصفة التي تميّزه باعتباره مالا من نوع خاص، والمراد معرفته من خلال هذا المقال هي الصفة التبرعية التي أعطاها المشرّع الجزائري للمال الموقوف، من خلال محاولة إسقاط هذا المدلول (التبرع) على المال الموقوف، لمعرفة مدى خصوصيته باعتبار الصفة التبرعية عند المشرع الجزائري |
| Description: | Recently and in our time El wakf moved from religious rite that allows people to be close to God and seeking his pleasure to another level of social instituation which has a big impact on the development with its sectors and requirements .So it has not only the role of social and economic development but also an important tributaries of progress in developing countries. The actual situation of El wakf is based on the characteristic that is specific on money,In this article what we want to show that the donation property that the algerian legislator gave to endowment funds , by dropping the donation on the endowments money in order to khnow how specific it is and considering its donation characteristic with algerian legislator. |
