| dc.description.abstract | لقد انتقل الوقف في عصرنا الحالي من موقع الشعيرة التي يتقرب فيها إلى تعالى ابتغاء مرضاته، إلى مستوى المؤسسة الاجتماعية ذات الأثر الكبير في التنمية بكل مجالاتها ومتطلباتها، فلم يعد يخف الدور الذي يقوم به الوقف في تفعيل التنمية الاجتماعية والاقتصادية، إذ صار رافدا مهمّا من روافد التطور في البلدان النامية. إنّ الوضعية التي يمتاز بها الوقف اليوم هي بالأصل راجعة إلى الصفة التي تميّزه باعتباره مالا من نوع خاص، والمراد معرفته من خلال هذا المقال هي الصفة التبرعية التي أعطاها المشرّع الجزائري للمال الموقوف، من خلال محاولة إسقاط هذا المدلول (التبرع) على المال الموقوف، لمعرفة مدى خصوصيته باعتبار الصفة التبرعية عند المشرع الجزائري | en_US |
