| Résumé: | نسعى من خلال هذه الدراسة إلى إبراز المراحل التاريخية التي مر بها تشريع الوظيف العمومي في الجزائر ، حيث أن دراسة الجانب التاريخي لقانون الوظيف العمومي لها أهمية كبيرة. فهي تُمكننا في واقع الأمر من معرفة أهم الثغرات القانونية ومجالاتها، والتناقضات العديدة التي مرت مؤسسة الوظيف العمومي، و يستفيد من هذه الدراسة كل من المُشرِع والقضاء و الفقه. إن أصل النصوص القانونية المُنظِمة للوظيف العمومي في الجزائر يرجع إلى الحقبة الاستعمارية الفرنسية، والملاحظ من خلال تتبع المراحل التي مر بها قانون الوظيف العمومي في الجزائر هو عدم وجود استقرار قانوني، بل إن البلاد مرت بمرحلة فراغ منذ صدور قانون العمل سنة 1990؛ والذي نص على إصدار القانون الأساسي للموظف. لكن هذا القانون لم يظهر إلا بعد مرور ستة عشر سنة من خلال الأمر رقم 06-03 المؤرخ في 15 يوليو 2006، ومن خلاله حدد المشرع التطام المغلق في التوظيف كقاعدة عامة، والنظام المفتوح كاستثناء في التوظيف. كما استثنى العديد من الفئات من تطبيق هذا النص القانوني نظرا لخصوصيات ومميزات كل فئة، وتؤكد المراحل التاريخية انعدام الأمن القانوني في الوظيف العمومي مما يؤدي إلى خلل في الموارد البشرية للإدارة ويؤثر على حسن سير المرفق العام |
| Description: | Through this article, we aim to highlight the historical stages that civil servicelegislation has gone through in Algeria, as studying the historical aspect of the public employment law is of great importance, as we can know the most important legal loopholes and contradictions that have gone through and both the legislator and the judiciary benefit from this study. The origin of the legal texts regulating public employment in Algeria dates back to the colonial era, and it is noticeable the lack of legal stability, moreover Algeria has gone through a void phase since the issuance of the labour law in 1990, which stipulated the issuance of the basic law for the employee. It did not appear until after 16 years through ordinance No. 06-03 of July 15, 2006, which the legislature defined closed-system employment as a general rule and the open system as an exception in employment. It also excluded many groups from the application of this legal text due to the peculiarities and characteristics of each category of stages. Witch confirms the absence of legal security in the public service that leads to a defect in the administrative human resources and affects the proper functioning of the public facility.
