| Abstract: | تحقق القواعد القانونية المتعلقة بتنظيم العمران توازنا بين المصلحة الخاصة للأفراد، وذلك من خلال مشاريع التجزئة وبين المصلحة العامة العمرانية، حيث تسهر الإدارة على تحقيق ذلك من خلال فرض أنظمة التراخيص الإدارية اللازمة، وذلك باحترام النصوص القانونية من بينها قرار رخصة التجزئة الأمر الذي يلزم الإدارة المختصة بإصدار قرار التجزئة، في حالة احترام الشخص المعني الإجراءات والمواعيد الضرورية لذلكـ وفي حالة مخالفة الإدارة يحق للأفراد المعنيين منازعتها، وذلك بالطعن في قرار رخصة التجزئة، وهو يظهر من خلاله الرقابة على القرارات الإدارية المتعلقة برخصة التجزئة سواء كانت رقابة إدارية أو رقابة قضائية. |
| Description: | The legal rules related to the organization of urbanization balance between the private interest of individuals through the retail projects and the general public interest. The administration ensures that this is achieved through the imposition of the necessary administrative licensing systems by respecting the legal provisions, In case the person concerned respects the necessary procedures and dates. In case of violation of the administration, the individuals concerned have the right to contest the decision of the retail license, which shows the supervision of the administrative decisions related to the license Whether it is administrative control or judicial control. |
