| Résumé: | هدفت السلطات الحكومية من سنها لقوانين خاصة بالتعمير و البناء إلى الحفاظ على النظام العمراني و البيئي، بعد أن كان التشييد يتم بصورة غير قانونية و هماجية و بدون رخص. و لمحاولة إصلاح ذلك و تسوية الوضعية و حماية الطبيعة العمرانية، تتكفل مصالح خاصة بالبناء على مستوى كل بلدية و كل دائرة و كل ولاية بتسوية البنايات بناءا على قوانين و تشريعات منصوصة من طرف الجمهورية الجزائرية. و في هذا الإطار ارتأينا من خلال هذه الورقة البحثية محاولة توضيح سيرورة الإجراءات الإدارية على مستوى البلدية من اجل الحصول على رخص التعمير. و عليه تنص إشكالية بحثنا هذا حول: كيف يتم الحصول على عقود التعمير من طرف البلدية؟ و هل كل عقود التعمير لها نفس السيرورة لاستخراجها ؟ |
| Description: | Enacting laws for reconstruction and construction to preserve the urban and environmental system have been the purpose of the government authorities, after the construction was carried out unlawfully and without permits the aim of government authorities behind initiating laws of construction and reconstruction is to preserve the urban and environmental system that has been carried out unlawfully and with no permits. And in order to settle the situation and to protect the urban nature, building departments at the level of each municipality, will ensure the settlement of buildings according to the laws and regulations of the Republic of Algeria. In this context, we seek through this research to clarify the process of administrative procedures in the municipality in order to obtain building permits. The problematic of this research is: How are the construction contracts obtained by the municipality? And do all reconstruction contracts have the same process of extraction? |
