| Résumé: | سعت غرفة التجارة الدولية إلى الحد من المخاطر التي قد يواجهها كل من المصدر و المستورد و حل الخلافات المحتملة بينهما ، و على هذا الأساس أعدت مجموعة من القواعد التي سمتها ( شروط التجارة الدولية Incoterms ) حتى تضمن الأمان القانوني و تبسط الإجراءات التجارية التي يقوم بها معاملي التجارة الدولية ، و هي شروط خضعت منذ إعدادها إلى التحديث و التطوير ، فجاءت عبر مجموعة من النس كان آخرها شروط التجارة الدولية 2020 . هدفت الدراسة إلى تحليل واقع إستخدام هاته الشروط في الجزائر، و خلصت الدراسة إلى وجود العديد من العوامل التي تحد من إستخدام كافة الشروط في الجزائر، أهمها الق وانين و التشريعات المتعلقة بالنقل البحري و التأمين الدولي، بالإضافة إلى عدم إلمام أغلب مستخدميها في الجزائر بكيفية اختيار الشروط المناسبة و طريقة إستخدامها. |
| Description: | The International Chamber of Commerce seeks to reduce the risks that the exporter and importer may face and to resolve potential disputes between them, for this reason, it prepared a set of rules called (Incoterms) in order to simplify and clarify the obligations and responsibilities between them. Since their issuance, these incoterms have been subject to modernization and updates, so they came in several versions, the last of which was the 2020 version. The study aimed to analyze the reality of the use of these incoterms in Algeria, it concluded that there are many factors that limit the use of all eleven incoterms in Algeria, the most important of which are the laws and legislations related to maritime transport and international insurance, in addition, most of incoterms users in Algeria are not familiar with how to choose the appropriate incoterm and how to use them correctly. |
