| Abstract: | يولي قانون العقوبات الجزائري اهمية كبيرة لحماية الضحية والشاهد لضمان سير العدالة بشكل عادل وفعال، يمنح الضحية حقوقا قانونية مثل المعاملة الكريمة ، الحماية من التهديد، مع امكانية الاستعانة بمحام، اما الشاهد فيلزم بأداء الشهادة بعد حلف اليمين، ويتمتع بالحماية من اي ضغط او ترهيب قد يؤثر على اقواله، كما اقر المشرع تدابير خاصة تشمل اخفاء الهوية وتوفير حماية جسدية لكليهما، مما يعزز الثقة في الجهاز القضائي ويشجع على التعاون مع العدالة دون خوف. |
| Description: | The Algerian Penal Code places significant importance on protecting the victim and the witness to ensure the fair and effective administration of justice. The victim is granted legal rights such as dignified treatment, protection from threats, and the possibility of consulting a lawyer. As for the witness, they are required to testify after taking an oath and are protected from any pressure or intimidation that may affect their testimony. The legislator has also established special measures, including identity concealment and physical protection for both, which strengthens confidence in the judicial system and encourages cooperation with justice without fear |
