| Abstract: | الإفلاس والتسوية القضائية اليتين قانونيتين متميزتين لحماية حقوق الدائنين في حالى توقف المدين عن الدفع، تدف الدراسة الى تحليل كافة الاجراءات القانونية المنصوص عليها في القانون التجاري لتنظيم هذين النظامين ، خاصة في ظل التعديلات الأخيرة لقانون الاجراءات المدنية والادارية، ومايفترض ان يلحق بالقانون التجاري من تعديلات ملائمة لتوجه المشرع في هذا الصدد ، من أجل ذلك جاءت دراستنا لبيان العديد من مواطن الجدة في الموضوع ومايجب ان يصير اليه حال القوانين ذات الصلة. |
| Description: | Bankruptcy and judicial settlement are distinct legal tools specifically designed to protect creditors when a debtor simply can't pay their bills anymore. My study aims to really dig into all the legal steps found in Algeria's Commercial Code that govern these two systems. This is super important, especially with the recent updates to the Civil and Administrative Procedures Law, and considering the upcoming changes that are expected in the Commercial Code itself to match what our lawmakers are aiming for. That's why this research highlights several fresh points about the topic and suggests how these key hows should evolve |
