| Abstract: | ان الغاية الأساسية لوجود سلطة قضائية هي تطبيق احكام القانون والفصل في المنازعات من خلال اصدار الأحكام والقرارات، التي من شانها تطبيق مبدأ سيادة القانون وسريانه على الكافة وتحقيق العدالة ، وبالتالي ضمان الحقوق العامة والخاصة ، وضمان الشرعية والمشروعية ورقابة اداء السلطة التنفيذية. |
| Description: | The basic purpose of the existence of a judicial authority is to apply the provisions of the law and to adjudicate disputes through judgements and decisions, which would apply the principle of the rule of law to all and bring about justice, thereby guaranteeing public and private rights, guaranteeing legality and legitimacy and monitoring the functioning of the executive branch. Any delay or omission in the judgement or judicial decision by those responsible for its execution or application shall be regarded as a challenge to the judgement or decision and to the functioning of the judiciary, thereby violating the principle of the rule of law and the separation of powers, which are the fundamental pillars of the State.The work of the judiciary is measured by the percentage of the implementation of judgements and decisions, not by the number of judgements and decisions handed down. As a result, the Algerian legislature has approved mechanisms for the right holder, which have led to responsibilities (personal responsibility, accompanying responsibility) and have provided for penalties for any employee (real estate governor) who has been arbitrarily prevented or delayed in the judgement or decision. |
