| Abstract: | يُعد القرار المشيخي لسنة 1863 إحدى أبرز المحطات في مسار السياسة الاستعمارية الفرنسية في الجزائر، حيث سعى هذا القرار إلى إعادة تشكيل بنية الملكية العقارية بما يخدم مصالح الاستعمار. فقد أدى إلى تحويل الأراضي الجماعية التي كانت تحت تصرف القبائل إلى أملاك فردية، مما ساهم في زعزعة التماسك الاجتماعي وخلق حالة من التفاوت والاضطراب داخل المجتمع الجزائري. ولم تقتصر تداعيات القرار على المجال العقاري فقط، بل امتدت لتؤثر على الجوانب الاقتصادية والاجتماعية، حيث ساعد في تفكيك البنية التقليدية للقبيلة وزرع بذور الانقسام داخلها. وهكذا شكّل القرار المشيخي أداة فعالة في يد الاستعمار لإعادة هندسة المجتمع الجزائري بما يتماشى مع أهدافه الاستيطانية. |
| Description: | The 1863 "Senatorial Decree" (also referred to as the "Sheikhly Decision") marked one of the most significant milestones in the trajectory of French colonial policy in Algeria. This decision aimed to restructure land ownership in a way that served colonial interests. It led to the transformation of communal tribal lands into individual properties, which disrupted social cohesion and created a state of inequality and unrest within Algerian society. The consequences of the decision were not limited to land issues but also extended to economic and social dimensions, contributing to the dismantling of the traditional tribal structure and sowing division within it. Thus, the Sheikhly Decision became an effective tool used by colonial authorities to reshape Algerian society in line with their settler ambitions |
