| Abstract: | يحتل نظام الأموال في القانون الدولي الخاص مكانة هامة وهذا بالنظر لأهميتها من جهة وتنازع القوانين التي تثيره في نطاق العلاقات الخاصة الدولية من جهة ثانية ، وقد تبين من خلال الدراسة ان قاعدة خضوع الأموال لقانون موقعها لم يافل بريقها ، بل كل ماترتب عن التطور الذي لحق فكرة الأموال على إثر التطور الإقتصادي والتكنولوجي هو ايجاد بدائل بمسميات مختلفة لمصطلح المكان، سواء في ظل المنهج التنازعي التقليدي او في ظل المناهج المباشرة التي اصبحت تقدم كبديل للمنهج التنازعي او كمساعد له. |
| Description: | The system of funds in private international law occupies an important place, in view of the importance of the system and the conflict of laws that it provokes within the international private relations. This study has shown that the rule of subjection of funds to the law of their location has not decline. Rather, all that has resulted from the development of the idea of funds following economic and technological development is the creation of alternatives with different names to the term “place”, both under the traditional conflict approach and under the direct approaches that have come to be presented as an alternative to or an adjunct to the conflict approach |
