| Abstract: | تناولنا في موضوع مذكرتنا مسؤولية الدولة عن اعمال السلطة القضائية ، وبالتحديد مسؤوليتها عن الأخطاء التي يرتكبها مرفق القضاء، بحيث ان الدولة ظلت لفترة طويلة بدون مساءلة ، ومع الدور الفعال الذي لعبه الفقه في اواخر القرن التاسع عشر، تم اقرار مسؤولية الدولة عن الأخطاء القضائية وواجب التعويض ، وكرس هذا المبدأ في مختلف الدول، وتبناه المشرع الجزائري منذ دستور 1976 وفصل في حيثياته بصدور القانون 01-08 سنة 2001 حيث تم انشاء لجنة التعويض على مستوى المحكمة العليا للنظر في قضايا التعويض. |
| Description: | in the subject of our memorandum, we discussed the state’s responsibility for the actions of the judicial authority, specifically for errors committedby the judiciary, such that the state remained without accountability fore a long time, and withe the rffective eole played by jueisprudence in the late nineteenth centry, the state’s responsibility for minor errors and the duty of compensation were recognized this principle was enshrined in various countries, and the algerian legislator adopted it since the 1976 constitution, and its merits were decided upon by the issuance law 01-08 in 2001 where the comprntion committe was established,at the level of the supreme court to condider compensastion cases , the condition and modalitird of compensation have been codifird, and algerian is still working ti the 2020 constitution, despite this, the scop of compensation remains incomplete,with the increasing volume of judicial errors |
