| Abstract: | تعتبر الحضانة من أهم مسائل تنازع القوانين في الأحوال الشخصية ، فقد أثار القانون واجب التطبيق جدلا فقهيا وقضائيا في ظل اختلاف التشريعات حول تحديد الطبيعة القانونية للحضانة وكذا اختلافهم في وضع قاعدة اسناد خاصة بها، كما قد يترتب على تحديد القانون واجب تطبيق اشكالات قانونية واخرى عملية بالاضافة الى اشكالية تحديد الجهة القضائية الدولية المختصة بالفصل في نزاعات الحضانة الناجمة عن الزواج المختلط وتنفيذ الأحكام الأجنبية. |
| Description: | custody is one of the biggest law conflicts in personal status. The law has raised jurisprudential and judicial controversy of different legislations concerning the determination of the legal nature of custody and their difference in setting its own attribution rule .The law has to determine the legal and practical problems in addition to the problem of determining a competent international judicial authority in order to adjudicate custody disputes |
