| Résumé: | یعتمد المشرع الجزائري في عملیة إثبات الملكیة العقاریة على العدید من السندات القانونیة التي تختلف من حیث طبیعتها ومضمونها ومدى حجیتها؛ حیث كان ذلك نتیجة الحقبة الاستعماریة غیر أنه ورغم استحداث نظام الشهر العیني إلا أنه تواصل العمل وتواكبت أحكام نظام الشهر الشخصي نظرا لتكلفة وتماطل عملیة المسح العام الذي بدوره یؤدي إلى إنشاء الدفتر العقاري التي تسلمه هیئة إداریة تسمى المحافظة العقاریة حیث یعتبر وثیقة البحتة المثبتة للملكیة العقاریة وعلیه نمیز طرق إثبات الملكیة فیما یلي: تم إنشاء بما یسمى العقد العرفي ثابت التاریخ قبل الفاتح جانفي 1971 مرورا بعدها بما یسمى بالعقد الرسمي الصادر بموجب قانون التوثیق الذي بموجبه اعتمد الشكلیة في العقد ثالثا سندات إداریة تكون على شكل قرارات وعقود إداریة ثم أخیرا أحكام وقرارات قضائیة تارة تكون مصرحة للملكیة العقاریة وتارة أخرى ناقلة لها |
| Description: | In the process of proving real estate ownership, the Algerian legislator relies on many legal documents that differ in terms of their nature, content, and extent of validity. This was a result of the colonial era. However, despite the introduction of the real estate registration system, work continued and the provisions of the personal registration system kept pace due to the cost and procrastination of the general survey process, which in turn leads to the creation of the real estate booklet, which is handed over to an administrative body called the Real Estate Governorate, where it is considered the pure document proving real estate ownership. Accordingly, We distinguish the methods of proving ownership as follows: The so-called customary contract with a fixed date was established before January 1, 1971, followed by the so-called official contract issued in accordance with the Notarial Law, according to which formality was adopted in the contract. Third, administrative documents in the form of administrative decisions and contracts, and then finally, judicial rulings and decisions, sometimes authorizing real estate ownership and at other times transferring. Its keywords are official contract, customary contract, real estate booklet, administrative contracts and decisions. |
