| Abstract: | تهدف هذه الدراسة القانونية الى تبين الدور الفعال الذي تلعبه رخصة البناء من أجل ضمان حركة البناء كما تعد أداة قانونية رقابية لأشغال البناء و التوسع العمراني. لا تقدمها الادارة الا اذا توفرت الشروط و الاجراءات القانونية المنصوص عليها في قوانين التهيئة والتعمير .كما تعد من اهم الاليات الوقائية لحماية البيئة من انعكاسات العمران العشوائي واللاشرعي .حيث تساهم بشكل كبير في حماية البيئة لاسيما من خلال الشروط المفروضة على البناية والاجراءات البيئية المسبقة الواجب اتباعها للحصول عليها والتي تضمن بشكل فعال تحقيق اهداف التنمية المستدامة. |
| Description: | The legal study aims at clarifyjing the effective role played by the building permit in guaranteeing the movement of construction.It is considered a lagal tool for the supervision of construction work and urban expansion.It is not granted by the administration unless the conditions and legal procedures provided for it in the laws of planning and construction are met. Of the ramification of illegal construction, the construction license contributes significantly to the protection of the environment, especially through the conditions imposed on the building and the prior environmental procedures to be followed to obtain them which effectively ensures sustainable development. |
