| Abstract: | كرّس المشرّع الجزائري الوساطة بموجب القانون رقم08-09 و هي أسلوب يُتخذ لإيجاد حل ودّي للنزاع - العقاري القائم بين الخصوم، عن طريق الحوار و تقريب وجهات النظر، بمساعدة شخص محايد و هو الوسيط. تتناول هذه الدراسة أهم الشروط التي يفرضها القانون الإحالة النزاع على الوسيط، و مصير الوساطة في حالة رفض أو قبول الأطراف المتخاصمة سندا تنفيذيا، أي أنّ الوساطة تجد حلا نهائيا للنزاع. غير تجدر الإشارة، و يعتمد نجاح الوساطة العقارية على القاضي الذي عليه بذل كل ما في وسعه من جهود لتعريف الخصوم بها و حثهم على إجرائها، و على حسن نيةّ الخصوم في السعي الفعلي لإيجاد حلّ ودي للنزاع، كما يعتمد نجاحها أيضا على الوسيط |
| Description: | The Algerian legislator established mediation under Law No. 08-09. It is a method based on search for an amicable solution to the dispute between adversaries, through dialogue and convergence of views, with the help of a neutral person, who is the mediator. This study deals with the most important conditions for referring the dispute to the mediator by the magistrate for land issues, and the fate of mediation in the event of rejection or acceptance by the belligerent parties, as their consent is a condition for its validity. The record drawn up by the mediator and signed by the belligerent parties becomes an enforceable instrument, which means that the mediation gives a final solution to the dispute. However, reference should be made that the success of real estate mediation depends on the judge who must make every effort to inform them about it and urge them to accept it, and on the goodwill of the adversaries in the actual pursuit of an amicable solution to the dispute, and its success depends on the mediator as well |
