| Abstract: | تعرضنا في هذه المذكرة إلى دراسة مفهوم جنحة نشر أو ترويج الأخبار أو الأنباء الكاذبة في التشريع الجزائري، من عدّة جوانب ومن خلال فصلين أساسيين فقد تناولنا في الفصل الأوّل العلّة من تجريم فعل النشر أو ترويج الأخبار الكاذبة وذلك بالتطرق إلى تأثير شائعات على الرأي العام. ومن ثم مناقشة تعارفيها وأركانها اللازمة لقيام الجريمة. حيث درسنا في الفصل الثاني الإجراءات اللازمة لقمع ومتابعة الجريمة من خلال توضيح العقوبة التي أقرها المشرع ومن ثم توضيح الجهات المختصة في متابعة جريمة نشر الأخبار الكاذبة. |
| Description: | In this memorandum, we studied the concept of the misdemeanor of publishing or promoting false news in Algerian legislation from several aspects and through two main chapters. In the first chapter, we addressed the reason for criminalizing the act of publishing or promoting false news by discussing its impact on public opinion. We then discussed its definitions and the essential elements required for the crime to be established. In the second chapter, we examined the necessary procedures for suppressing and prosecuting the crime by clarifying the penalties prescribed by the legislator and then explaining the authorities responsible for following up on the crime of publishing false news |
