| Abstract: | سعى المشرع الجزائري إلى تحسين السياسة الجنائية لمكافحة الجريمة والتقليل منها في البلد. وذلك من خلال اتخاذ إجراءات جديدة تسهم في تسريع الإجراءات القضائية وتخفيف الاكتظاض في المؤسسات العقابية فقد تبنى المشرع إجراءات المثول الفوري كبديل عن إجراء التلبس، وذلك بموجب الأمر 15 - 02 المعدل والمتمم لقانون الإجراءات الجزائرية المؤرخ في 07 شوال 1436 ه الموافق 23 يوليو سنة 2015 ، يعدل ويتمم الأمر رقم 66 - 155 ومن خلال هذا الإجراء، يتم ضمان محاكمة عادلة للمتهمين في فترة زمنية قصيرة دون المساس بحقوقهم وحرياتهم الأساسية. وبالتالي يمكن تقليل الزمن الذي يقضيه المتهمون في الانتظار قبل المحاكمة، وتقليل الاكتظا في المؤسسات العقابية. هذا يسهم في تعزيز العدالة وتحقيق الهدف من العقوبة بشكل أفضل، مع مراعاة الحقوق الأساسية للفرد |
| Description: | The Algerian legislator sought to improve criminal policy to combat crime and reduce crime in the country. This is done by taking new measures that contribute to speeding up judicial procedures and reducing overcrowding in penal institutions. The legislator adopted immediate appearance procedures as an alternative to the flagrante delicto procedure, pursuant to Order 15-02 amending and supplementing the Code of Criminal Procedure Dated 07 Shawwal 1436 AH corresponding to 23 July 2015, amends and supplements Order No. 66-155. Through this procedure, a fair trial is guaranteed to the accused in a short period of time without prejudice to their fundamental rights and freedoms. Thus, the time defendants spend waiting before trial can be reduced, and overcrowding in penal institutions can be reduced. This contributes to enhancing justice and better achieving the goal of punishment, taking into account the fundamental rights of the individual |
