| Résumé: | العنف ضد الأصول من الجرائم التي عرفت انتشارا واسعا في المجتمع الجزائري، دون ان تحظى بالاهتمام الكافي وهو من الأسباب التي جعلتنا نهتم بها ونبحث فيها حتى نتوصل الى تحديد الأسباب المؤدية الى انتشار هذا النوع من الجرائم التي تعتبر دخيلة على مجتمعنا الإسلامي المحافظ، كذلك أردنا دراسة هذه الجريمة من الناحية القانونية وهذا ما انصب عليه بحثنا حتى نبين موقف المشرع الجزائري من هذه الجرائم ومدى الحماية القانونية المقررة للأصول اتجاهها، وما يترتب عنها من جزاءات وعقوبات ضد مرتكبي هذه الجرائم، مع الأخذ بعين الاعتبار شرط صلة القرابة بين الأصول والفروع وهذا ما يميز جرائم العنف ضد الأصول عن غيرها من جرائم العنف ضد الأشخاص. |
| Description: | Violence against property is one of the crimes which has largely widespread in Algerian society without her receiving Enough Attention and that's one of the reasons who we were able to identify the reasons that have leads to the spread of this type of crime who is considered alien to our conservative Islamic society We wanted to study this crime from a legal point of view and this is what our research has focused on In order to clarify the position of the Algerian legislator concerning these offences and the consequences of penalties and sanctions against the perpetrators of these offences given the condition of kinship between origins and branches is what distinguishes crimes of violence against assets from other crimes of violence against persons |
