| Résumé: | تعد الرقابة على السلطة التقديرية لقضاة محكمة الجنايات ضرورة حتمية لضمان العدالة ومنع التعسف في الأحكام. تشكل جزءاً لا يتجزأ من نظام العدل. القضاة يجب أن يعملوا ضمن الإطار القانوني مع الإبقاء على قدر من الاستقلالية يمكّنهم من تقدير الظروف الخاصة بكل قضية. الالتزام بالمعايير القانونية والإشراف القضائي يضمن أن تكون القرارات التي يُتخذها القضاة موضوعية ومعقولة، وليست نتيجة للتحيز أو التعسف . تحقيق التوازن بين استقلال القاضي والرقابة على أحكامه يوجه النظام القضائي نحو الشفافية و المحاسبة، مما يعزز من ثقة الناس في العدالة. هذا التوازن يُمكن أن يؤدي إلى تنمية نظام قضائي رصين يجعل من العدالة ليست مجرد مبدأ، بل واقع ملموس في حياة الناس . |
