| Abstract: | لما كانت تختلف التصرفات التي يقوم بها الشخص بحسب الأهلية التي يكتسبها، فإن الذمة المالية للأصيل يقع عليها أعمال تنقسم إلى كل من أعمال الإدارة وأعمال التصرف إضافة إلى أعمال الحفظ، يختلف كل صنف منها عن الآخر ما يستوجب ضرورة التمييز بينهما في المعاملات المالية لاسيما بين أعمال الإدارة وأعمال التصرف. كما تختلف التزامات ومسؤولية الشخص القائم بأعمال الإدارة عن التزامات ومسؤولية الشخص القائم بأعمال التصرف باعتبار أن هذه الأخيرة تخول له صلاحيات أوسع من الأولى –أعمال الإدارة، هذا وتجد كل من أعمال الإدارة وأعمال التصرف تطبيقاتها في القانون الجزائري، حيث تظهر أعمال الإدارة جلية في عقد الإيجار وإدارة أموال القصر، أما أعمال التصرف أبرز نموذج تطبيقي لها عقد الوكالة والتصرف في المال المشاع بعقد جماعي |
