| Abstract: | إن هدف المشرع الجزائري من خلال افتراض سكوت الإدارة تعبيرا عن إرادتها اما بالرفض أو القبول و إدخاله في سياق نشاطها باعتباره قرارا إداريا سواء كان ذلك قرار سلبي أو قرار ضمنيني، كان من أجل حمحماية مصالحلح الألأفراد من تعسف الإلإدارة من جهة و مراعاة ظروف عملها من جهة أخرى ، لكن هذه الموازنة رتبت آثارا ، انعكست سلبا على كل من الأفراد و الإدارة و حتى القضاء بالإضافة إلى حالات الفراغ القانو ني المسجل، وهو ما فتح المجال للآراء الفقهية والإجتهادات القضائية لتعويض هذا الفراغ رغم ما أقره المشرع من ضمانات حماية لحقوق الأفراد وحرياتهم من جراء القرارات الناشئة عن سكوت الإدارة وعدم الرد ، ما فرض على المشرع تبني ج جديد في تنظيم أحكام سكوت الإدارة |
| Description: | The goal of the Algerian legislator, by assuming the silence of the administration as an expression of its will, either by rejection or acceptance, and introducing it into the context of its activity as an administrative decision, whether that was a negative decision or an implicit decision, was in order to protect the interests of individuals from the arbitrariness of the administration on the one hand, and to take into account the conditions of its work on the other hand. However, this budget has had nega tive effects on individuals, the administration, and even the judiciary, in addition to the recorded legal vacuum, which has opened the way for jurisprudential opinions and judicial jurisprudence to compensate for this vacuum, despite the guarantees approv ed by the legislator to protect the rights and freedoms of individuals as a result of the decisions arising from the law.
