| Résumé: | تناولت الدراسة موضوع حقوق الانسان في حالة الطوارئ ذلك الموضوع الذي اكتسب مجالا واسعا في الوقت الحالي، نظرا لما تمر به الدول بأوضاع خطيرة كحالة الطوارئ والتي عرفت في الجزائر بالمرسوم 44/92 الخاص باعلانها الذي فرض مجموعة من التدابير الاستثنائية التي تشكل انعكاسات وقيدا حقوق الفرد وحرياته تحت مقولة "الضرورات تبيح المحضورات". الا ان ورغم المساس بجوهر هذه الحقوق مازات تحضى بمكانة هامة واهتمام خاص وكونها تتصف بطابع الديمقراطية كرس لها المشرع الجزائري ضمانات تكفلها من اي تجاوز وانتهاك. |
| Description: | Our study dealt With the issue of human rights in light of the state of emergency that subject that has gained a wide scope at the present time due to whate countries are going through in dangerous situations such as the state of emergency which was known in Algeria by decree 92/44 of its declaration which imposed a set of exceptional measures that constitute repercussions on individual rights and freedoms Under the argument of necessities permitting prohibitions. however despite the violation of the essence of these rights they still enjoy an important place and special attention being one of the sensitive issues that are characterized by the nature of democracy |
