| Abstract: | تعد جريمة تعارض المصالح صورة من صور الفساد الاداري المستحدثة، بموجب المادة 34 من قانون 06-01 المتعلق بالوقاية من الفساد ومكافحته، اذ كان لتفشي هذه الجريمة اثر على المصالح الادارية خاصة في مجال الصفقات العمومية والتي نص عليها المشرع بموجب المرسوم الرئاسي 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، وبالرجوع للمادة 08 التي الزمت الموظف العمومي بأخبار سلطته السلمية في حال تواجده في وضعية تتعارض فيها مصلحته الخاصة مع المصلحة العامة، وقد اقر المشرع الجزائري عقوبات تصل الى 5 سنوات بالإضافة الى الغرامة المالية، وذلك في حال عدم اخباره عن وجود هذا التعارض والذي من شأنه ان التأثير على ممارسة مهامه بشكل عادي |
| Description: | The crime of conflict of interest is a new form of administrative corruption, according to Article 34 of Law 06-01 related to preventing and combating corruption, as the spread of this crime had an impact on administrative interests, especially in the field of public transactions, which were stipulated by the legislator by virtue of the presidential decree.15-247, which includes the organization of public deals and public utility mandates, and with reference to Article 08, which obligates the public official to inform his peaceful authority in the event that he is in a situation in which his private interest conflicts with the public interest, and the Algerian legislator has approved penalties of up to 5 years in addition to the financial fine, in If he is not informed of the existence of this conflict, which would affect the normal exercise of his duties |
