| Résumé: | تعد جريمة تعارض المصالح صورة من صور الفساد الاداري المستحدثة، بموجب المادة 34 من قانون 06-01 المتعلق بالوقاية من الفساد ومكافحته، اذ كان لتفشي هذه الجريمة اثر على المصالح الادارية خاصة في مجال الصفقات العمومية والتي نص عليها المشرع بموجب المرسوم الرئاسي 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، وبالرجوع للمادة 08 التي الزمت الموظف العمومي بأخبار سلطته السلمية في حال تواجده في وضعية تتعارض فيها مصلحته الخاصة مع المصلحة العامة، وقد اقر المشرع الجزائري عقوبات تصل الى 5 سنوات بالإضافة الى الغرامة المالية، وذلك في حال عدم اخباره عن وجود هذا التعارض والذي من شأنه ان التأثير على ممارسة مهامه بشكل عادي |
