| Résumé: | تمثل المؤسسة العمومية الاقتصادية نواة السياسة الاقتصادية الوطنية لكونها أداة فعالة في تحقيق التنمية الاقتصادية، لذا سعى المشرع الج ا زئري لتكريس بعدها التجاري بإضفاء الصبغة التجارية عليها رغم طبيعتها العمومية، وذلك لفتح المجال للدخول في المنافسة التجارية في السوق الوطنية والعالمية وفق ما تفتضيه متطلبات اقتصاد السوق. فتكون بذلك المؤسسة العمومية الاقتصادية بذلك شخص قانوني منظم يتمتع بالشخصية المعنوية والاستقلال المالي والإداري يقوم بنشاط اقتصادي تجاري متخذا قالب او تنظيم شركات رؤوس الأموال المنصوص عليها في القانون التجاري خاضع للقانون الخاص، يطبق عليه قواعد واحكام القانون التجاري والنصوص الخاصة نزولا عند طابعه العمومي. |
| Description: | The economic public institution represents the nucleus of the national economic policy because it is an effective tool in achieving economic development, so the Algerian legislator sought to devote its commercial dimension by giving it a commercial character despite its public nature, in order to open the way for entering into commercial competition in the national and global market according to the requirements of the market economy. Thus, the economic public institution is thus an organized legal person enjoying moral personality and financial and administrative independence, carrying out commercial economic activity taking the form or organization of capital companies stipulated in the commercial law subject to the private law, to which the rules and provisions of the commercial law and special texts are applied according to its public nature. |
