| Abstract: | يعتبر عقد الكفالة من أهم العقود المستعملة في الوقت الراهن، كونه يوفر للدائن الأمان في الحصول على حقوقه عند حلول الأجال المحددة، فهو يتمتع بمميزات تميزه عن المفاهيم الأخرى المشابهة له. ولتكوينه لا بد من توافر أركان حتى ينشأ نشوءا صحيحا مثله مثل العقود الأخرى، وتترتب بين الدائن والكفيل، وبين المدين والكفيل آثارا قانونية، كما ينقضي عقد الكفالة إما بطريقة تبعية وأصلية |

In order for it to be formed, there must be elements in order for it to arise properly, like other contracts, and legal effects ensue between the creditor and the guarantor, and between the debtor and the guarantor, just as the guarantee contract expires either in a subordinate or original manner |
