| Abstract: | تكتسي العلامة التجارية أهمية كبيرة لما لها من دور في التنمية الاقتصادية والمعاملات التجارية كما أنها وسيلة من وسائل المنافسة المشروعة بين المنتج والتاجر حيث تسهل للمستهلك التعرف على المنتجات ، فترد على العلامة التجارية عدة تصرفات منها الناقلة لملكيتها بعوض مثل البيع الذي يكون بين مالك العلامة الذي يعتبر البائع وبين المشتري مقابل ثمن نقدي ، والتصرفات بدون عوض كالهبة التي تكون بين الواهب والموهوب له ، وكذا الوصية التي تنقل ملكية العلامة التجارية من مالكيه المسمى الموصى له . ويوجد تصرفات غير ناقلة لملكية العلامة بالتجارية منها الرهن الذي نرجع من خلاله إلى تطبيق أحكام العامة ورهن الحيازي أي تنتقل من المرهون إلى المرتهن ، والترخيص بإستغلال العلامة التجارية الذي يشبه كثيرا عقد الإيجار . كلا التصرفين لابد من تسجيلها في السجل العلامات التجارية ونشرها في الصحف الرسمية لدى الجهة المختصة |
