| Abstract: | يعد موضوع الحضانة من المواضيع التي استحوذت على اهتمام الباحثين والمفكرين سواء الفقهاء أو رجال القانون لما تثيره من إشكالات خاصة إذا تعلق الأمر بالحضانة في الزواج المختلط على المستوى الدولي سواء من ناحية القانون الواجب التطبيق وأي القوانين التي تحكمها وفي هذا الإطار سعت بعض التشريعات إلى وضع قاعدة إسناد خاصة بها وربطتها بضوابط إسناد تتناسب مع مصلحة الطفل المحضون وفي المقابل أدركت غالبية الدول دور الاتفاقيات في محاولة إيجاد حلول للنزاعات التي تثيرها العلاقات الأسرية ذات العنصر الأجنبي قامت العديد من الدول بإ برام اتفاقيات دولية أو ثنائية تسعى لإيجاد حلول لتنازع القوانين في مسائل الأحوال الشخصية. |
| Description: | The issue of custody is one of the topics that have captured the attention of researchers and thinkers, whether jurists or jurists, because of the problems it raises, especially when it comes to custody in mixed marriages at the international level, both in terms of the applicable law and any laws that govern it.
