| Abstract: | شهدت الجزائر في الآونة الأخیرة ظروف صعبة على غرار بقیة الدول أدت إلى بروز ظواهر اجتماعیة واقتصادیة خطیرة منها المضاربة غیر المشروعة كظاهرة فتاكة بالاقتصاد الوطین والقدرة الشرائیة للمواطن؛ أي المستهلك الأمر الذي أدى إلى التدخل السریع من قبل المشرع من خلال تبني قانون جدید یهدف إلى مكافحة المضاربة غیر المشروعة وإقرار عقوبة جزلئیة صارمة في حق من یرتكب هذه الجریمة تحقیقا لغایة الردع من جهة وحمایة مصلحة المستهلك من جهة أخرى ولم ینص المشرع على تعریف المضاربة بخلاف القوانین الأخرى التي وضعت تعاریف محددة |
