| Résumé: | يتميز القانون الجنائي بمبدأ عدم رجعية القوانين الجنائية، حيث لا تسري تلك القوانين على الأحداث التي وقعت في الماضي، سواء فيما يتعلق بالوقائع التي حدثت أو بالمراكز القانونية التي تكونت وفقا للقانون القديم. وقد اعتمد المشرع الجزائري على المبدأ في الدستور في نص المادة 43 ، بالإضافة إلى المادة 02 من قانون العقوبات الجزائري. ويعتبر هذا المبدأ أحد أهم نتائج مبدأ الشرعية . ومع ذلك، يوجد استثناء لمبدأ عدم الرجعية نتيجة تنازع القوانين من حيث الزمان، وهو ما يُعرف ب "القانون الأصلح للمتهم". ووفقا لهذا الاستثناء، يطبق النص الجنائي بأثر رجعي على الماضي إذا كان في صالح للمتهم. بذلك يبقى الأصل في تطبيق القوانين الجنائية عدم رجعيتها، والاستثناء رجعية القوانين بحكم صلاحها للمتهم |
| Description: | Criminal law is characterized by the principle of non-retroactivity of criminal laws, where such laws do not apply to events that occurred in the past, whether it concerns the actions that took place or the legal statuses that were established according to the old law. The Algerian legislator has adopted the principle in the constitution, specifically in Article 43, in addition to Article 02 of the Algerian Penal Code. This principle is considered one of the most important outcomes of the principle of legality. However, there is an exception to the principle of non-retroactivity due to conflicts between laws regarding their temporal application, which is known as the "most favorable law to the accused." According to this exception, the criminal provision can be applied retroactively to the past if it is beneficial to the accused. In that regard, the fundamental principle remains the non-retroactivity of criminal laws, with the exception of their retroactivity based on their relevance to the accused's benefit |
