| Abstract: | أدلى التقدم العلمي الهائل في مجال تكنولوجيا المعلومات وتدفقها الى ظهور مايعرف بجريمة المعلوماتية التي اتخذت عدة اشكال ، وتتمثل خطورة هذه الظاهرة الاجرامية المستحدثة في سهولة ارتكابها نحو اثارها ، خاصة انها تقع على بيانات ليس لها كيان مادي ملموس مما يؤدي الى ظهور مشكلات كبيرة في جمع الأدلة واثبات هذه الجرائم. |
| Description: | The tremendous scientific progress in the field of information technology and its rapid flow has led to the emergence of what is known as cybercrime, which has taken various forms ,and the danger of this emerging criminal phenomenon lies in its ease of commission and the erasure of its traces, especially since it on data that lacks tangible material existence, which leads to numerous problems in gathering evidence and proving this type of crime. Our particular focus has on one of these emerging crimes, and which has not received significant attention from researchers despite its widespread prevalence in our society, is "defamation crime through social media platforms " . In light of rapid technological advancements and the immense popularity of social media platforms across various segments of society, most legislations and constitutions have been keen on protecting individual’s rights and freedoms. However, the shortcomings of legislative texts and their failure to keep pace with this progress have rendered them unable to effectively confront this type of crime , this has led many countries to address the situation and fill legal gaps by enacting and amending numerous legal texts that align with the modern criminal lanscape. Indeed, this type of cybercrimes has garnered international and national attention for combating it through the establishment of various international agreements |
