| Abstract: | ان المراحل المختلفة التي مرت بها الملكية العقارية والنصوص التي كانت تحكمها والتي لم تعرف انسجاما وتواصلا ولا تطبيقا ميدانيا لكثرتها وعدم تماشيها مع التقاليد والعرف السائدين في المجتمع. أدت الى كثرة المنازعات العقارية وتعقيدها ماجعل القضاء الجزائري يتصدى للنزاعات العقارية محاولا تطبيق النصوص القانونية وتحقيق مبدأ العدل والإنصاف. كما أن قواعد الإختصاص في المنازعات العقارية ليست مضبوطة بدقة وغير محسومة اذ يتنازع في كثير منها القاضي الإداري مع القاضي العادي, فينظر القضاء العادي مع القضاء الإداري في المنازعة العقارية بموجب الاختصاص الذي خوله القانون لكليهما,غير أنه تبرر حالات في الواقع القضائي تطرح تنازع بين تلك الجهات للفصل في هذا النوع من المنازعة. |
| Description: | The different stages that real estate ownership went through and the texts that governed it, which did not know consistency, communication, or field application due to their abundance and lack of conformity with the prevailing traditions and custom in society. It led to many real estate disputes and their complexity, which made the Algerian judiciary address real estate disputes, trying to apply legal texts and achieve the principle of justice and equity. Also, the rules of jurisdiction in real estate disputes are not precisely controlled and unresolved, as in many of them the administrative judge disputes with the ordinary judge. To adjudicate this type of dispute. This is due to the multiplicity of real estate disputes due to the multiplicity and complexity of the laws regulating it, where it is difficult for the judicial authorities of both kinds to be familiar with them in the absence of a system of specialization of judges on the one hand and the large number of management interventions to regulate and control the real estate field on the other hand. |
