| Résumé: | جاء هذا البحث من أجل إبراز الوسائل و الطرق المعتمدة من طرف المشرع الجزائري أثناء تصديو للوضع المزري الذي تمر به العدالة الجنائية، وهو ما لمسناه بالفعل من خلال اعتماده على إجراءات بديلة جاء بها الأمر رقم 15/02 المعدل والمتمم لقانون الإجراءات الجزائية نحو العدالة التصالحية كبديل للعدالة الجنائية التقليدية فيفهم من خلال ذلك أن المشرع الجزائري يقصد من وراء ذلك وجود طريق بديل في المصالحة القضائية و الوساطة التي تضع حدا للمتابعة الجزائية كطريق بديل لفض النزاعات بين الأشخاص بعيدا عن أروقة القضاء و جلساتو العلنية، والأمر الجزائي الذي يعد طريقة من طرق لإنهاء المتابعة في بعض الجنح التي تكون عقوبتها غرامة مالية، وأضحى من كونو نظاما استثنائيا من أهم الموضوعات القانونية التي أثارت وما زالت تثير جدلا واسعا عند التطبيق العملي. |
| Description: | This research came in order to highlight the means and methods adopted by the Algerian legislator while addressing the dire situation that criminal justice is going through, which we have already seen through its reliance on alternative procedures that came in Order No. 15/02 amending and supplementing the Criminal Procedure Code towards restorative justice as an alternative to traditional criminal justice. It is understood through this that the Algerian legislator intends behind this the existence of an alternative way in judicial reconciliation and mediation that puts an end to criminal prosecution as an alternative way to resolve disputes between people away from the corridors of the judiciary and its public sessions, and the penal order, which is one of the ways to end the follow-up in some misdemeanours. The penalty for which is a financial fine, and it has become an exceptional system of the most important legal issues that have raised and continue to raise wide controversy when applied in practice. |
