| Abstract: | تعد شهادة الشهود من أهم ركائز الإثبات في الدعاوي الجنائیة، لأن لها تأثیر كبیر في مصیر المحاكمات، حیث یكون لها دور حاسم في إدانة المتهم أو تبرئته، لذلك تتخذ حمایة الشهود أحد الأهداف الرئیسیة للسیاسة الجنائیة المعاصرة، ومن هنا یأتي دور الشهود في المنظومة القانونیة، ومساعدة الأجهزة القضائیة الجزائیة للوصول إلى أقصى درجات التحري، من خلال الوظیفة الأساسیة للشهود كوسیلة من أهم وسائل الإثبات في المواد الجنائیة، ولذلك سعى المشرع الجزائري إلى توفیر الحمایة اللازمة للشهود من خلال توفیر الحمایة الموضوعیة التي تضمنها قانون العقوبات وقانون الوقایة من الفساد ومكافحته والحمایة الإجرائیة من خلال إصدار الأمر 02/15 المعدل والمتمم لقانون الإجراءات الجزائیة الذي أدرج الفصل السادس إلى الباب الثاني من الكتاب الأول تحت عنوان "حمایة الشهود والخبراء والضحایا" والذي نص على حمایة الشهود من الاعتداءات أو التهدیدات التي قد یتعرضون لها بهدف تشجیعهم على الإدلاء بالشهادة. |
| Description: | Witness testimony is one of the most important pillars of evidence in criminal cases, because it has a significant impact on the fate of trials, as it has a decisive role in convicting or acquitting the accused. Therefore, witness protection is one of the main objectives of contemporary criminal policy, hence the role of witnesses in the legal system. And assisting the criminal judicial bodies to reach the highest levels of investigation, through the basic function of witnesses as one of the most important means of proof in criminal matters, and therefore the Algerian legislator sought to provide the necessary protection for witnesses by providing the substantive protection that was included in the Penal Code, the Law on Prevention and Combating Corruption, and procedural protection Through the issuance of Order 02/15 amending and supplementing the Code of Criminal Procedure, which included Chapter Six to Part Two of Book One under the title “Protection of Witnesses, Experts, and Victims,” which provided for the protection of witnesses from attacks or threats to which they may be subjected in order to encourage them to testify |
