| Abstract: | تضمن موضوع المذكرة، الحديث عن عملية المسح العقاري العام، حيث يعتبر من بين أهم المواضيع الشائعة والتي أثارت العديد من المشاكل القانونية والعملية، لذلك انصب اهتمامنا إلى التطرق لمختلف هذه المشاكل والمعوقات، كذلك المتعلقة بنقض العامل المادي والبشري ومختلف الإشكالات الناتجة عن الآليات القانونية لهذه العملية كذلك تلك الناتجة عن الترقيم المؤقت والنهائي، دون أن ننسى إشكالات الدفتر العقاري و مدى حجيته وإشكالية العقارات الغير مطالب بها أثناء عملية المسح. كما تطرقنا لبعض المقترحات في سبيل الحد من هذه العوائق ومحاولة إيجاد حلول لها وتحقيق هدف المسح العقاري في تطهير الملكية العقارية. |
| Description: | Our research covers the general real estate survey process because it is one of the most popular topics and has given rise to a number of legal and practical issues .we have therefore concentrated on these issues including those relating to the lack of the human and materiel factors , the various issues arising from the process legal mechanisms ,as well as those relating to the temporary and final numbering ,without neglecting the real estate book, the extent of its authority and the issue of unclaimed real estate during the survey process. We also talked about some ideas for reducing issues by locating remedies and achieving the objective of the real estate survey, which is to purge real estate ownership. |
