| Abstract: | كان من الطبيعي ان ينتهج المؤسس الدستوري على غرار دول العالم الرقابة القضائية بموجب التعديل الدستوري لسنة 2020 باستحداث محكمة دستورية كمؤسسة رقابة لفعاليتها في صون نصوص الدستور وهي ضرورة ملحة لاستمرار سير السلطات ، وتستقر بها العلاقات بينها وكلفها دون غيرها بضمان احترام الدستور وضبط سير المؤسسات الدستورية. |
| Description: | It was natural for the constitutional founder, following the example of the countries of the world, to pursue judicial oversight according to the constitutional amendment of 2020, by introducing a constitutional court as an oversight institution for its effectiveness in preserving the provisions of the constitution, which is an urgent necessity for the continuity of the functioning of the authorities, and the relations between them are stabilized. On the one hand, and in order for there to be a balanced relationship between the executive and legislative authorities, it must be taken into account that one authority does not interfere in the function of another authority by renewing its competences |
