Description: | The legislator, when determining the international jurisdiction of his courts, considers Litigation involving a foreign element, taking into account the considerations of justice With the aim of ensuring the unity of judicial litigation, and preventing conflicting judgments and ensure their implementation at the international level, based on these considerations, the state courts are competent to consider all cases related tolerated requests, preliminary questions, and incidental questions and take the necessary measures to prevent the violation of rights and property through the jurisdiction of provisional and conservatory measures, also The requirements of international judicial cooperation and considerations of the proper administration of justice may also require, in certain cases the national judge relinquishes jurisdiction in favor of his foreign counterpart, if it appears to him that he is better able to settle the dispute and guarantee the effects of the decision rendered in his regard in cases related to Lis- pendens and connexity. |
