| Abstract: | تعتبر المنازعات الأسرية خصوصا التي تحدث بين الزوجين من أهم القضايا التي أولت لها التشريعات السماوية وفي مقدمتها الشريعة الإسلامية وكذا القوانين الوضعية أهمية بالغة وهو ما سار عليه المشرع الجزائري، وأدرج لها إجراءات لحلها ويكون بطرق ودية تحت إشراف قاضي شؤون الأسرة الذي يتم عن طريق الصلح وجعل منه إجراء وجوبي وإلزامي قبل مناقشة الموضوع. كما يمكن له تعيين حكمين في حالة ما كان الخصام مشتد بين الزوجين لإجراء الصلح غير أن النصوص القانونية كانت قاصرة في الالمام بكافة الجوانب، مما حد من دور قاضي شؤون الاسرة في الحد من المنازعات بين الزوجين،ظهرت فكرة إدراج وسيلة الوساطة تساهم في تفعيل دور قاضي شؤون الأسرة التي إستثناه صراحة، رغم أنها متأصلة في المجتمع والقانون الجزائري، غير أن بوادر إدراجها مستقبلا نجد لها أثر من خلال مشاريع تعديل القوانين بعد أن أثبتت نجاحها في العديد من الدول |
| Description: | Family disputes, especially those that occur between spouses, are considered one of the most important issues addressed by divine legislations, particularly Islamic law, as well as secular laws. The Algerian legislator has given great importance to these disputes and has included procedures for their resolution, primarily through amicable methods under the supervision of a family affairs judge. This includes making reconciliation mandatory before discussing the issue further. The judge may also appoint mediators in cases where the dispute intensifies between the spouses. However, the legal texts were limited in their understanding of all aspects, which limited the role of the family affairs judge in reducing disputes between spouses. The idea of incorporating mediation as a means to activate the role of the family affairs judge emerged, despite it being deeply rooted in Algerian society and law. In the future, there are indications that mediation will be included through law amendments, as it has proven successful in many countries. |
