| Abstract: | إن مجلس المنافسة سلطة إدارية مستقلة تعمل على فرض احترام الشروط اللازمة بالمنافسة، ولاسيما ما يتمتع به من صلاحيات ردعية ضد المخالفين بعد إخطاره بالمقابل اْخضع المشرع مجلس المنافسة للرقابة القضائية المزدوجة التي يضطلع بها كل من القضاء العادي والإداري، ما يفتح تناقضا عميقا بين الطبيعة الإدارية لمجلس المنافسة، وما يتمتع به من امتيازات السلطة العامة التي لا تخضع اْعماله للفحص إلا من طرف القضاء الإداري، ورغم ذلك فإن المشرع الجزائري جعل بعض قراراته تفحص من طرف القضاء العادي |
| Description: | The Competition Council is an independent administrative authority that works to enforce respect for the necessary conditions in competition, especially its deterrent powers against violators after being notified. The competition council and the general authority it enjoys, whose actions are subject to examination only by the administrative judiciary. Despite that, the Algerian legislator made some of its decisions reviewed by the ordinary judiciary. |
